In short: TruStar Connect gives you tools to run and document your safety program. You stay responsible for your own safety performance and compliance, and AI features are aids that you must review for accuracy. The full terms below govern your use of the Service.

1. Agreement to These Terms

These Terms of Service ("Terms") form a binding agreement between TruStar Safety Inc. ("TruStar", "we", "us", or "our") and the individual or organization ("you", "your", or "Customer") that accesses or uses TruStar Connect and any related software, websites, and services (together, the "Service").

By creating an account, starting a trial, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you are entering into these Terms on behalf of an organization, you represent that you have the authority to bind that organization. If you do not agree, do not use the Service.

2. The Service

TruStar Connect is a software platform that provides tools to help organizations build, document, and manage their occupational health and safety programs and field operations. This includes features such as inspections and forms, incident investigation, hazard registers, corrective actions, document libraries, training records, equipment and maintenance tracking, observations, and related reporting.

The Service is a tool. It is designed to support and organize the work that you and your people perform. It does not perform that work for you, and it does not supervise, direct, or carry out any safety activity at your workplaces.

3. Customer Responsibility and Safety Disclaimer

You are solely responsible for your own safety program and for the health and safety of your workers, contractors, sites, and operations. This includes deciding what controls to apply, how to apply them, and whether the information in the Service is accurate, complete, and appropriate for your circumstances.

You are solely responsible for complying with all laws, regulations, codes, standards, and certification or audit requirements that apply to your business, including occupational health and safety legislation in the jurisdictions where you operate. The Service may reference regulatory or certification frameworks for convenience, but it does not constitute legal, regulatory, engineering, medical, or other professional advice, and it is not a substitute for the judgment of a qualified professional.

TruStar provides software tools only. We are not responsible or liable for your actual safety performance or outcomes, including any incident, injury, illness, fatality, property damage, environmental release, loss, fine, penalty, citation, failed audit, lost certification, or other consequence arising at or from your operations. Responsibility for safety performance rests entirely with you. Using the Service does not transfer any of that responsibility to TruStar and does not make TruStar a controller, employer, supervisor, prime contractor, or competent person for any workplace.

4. Artificial Intelligence Features

Some features of the Service use artificial intelligence to draft, summarize, suggest, analyze, or otherwise assist with content. These AI-assisted features are tools intended to aid the person doing the work. They are not a replacement for human judgment, expertise, or review.

AI-generated output can be incomplete, inaccurate, or unsuitable for your situation. You must review, verify, and edit all AI-assisted output for accuracy, completeness, and appropriateness before relying on it, publishing it, or acting on it. Nothing produced by an AI feature is professional advice, and you remain fully responsible for any content you keep, approve, or use, regardless of how it was generated.

5. Accounts and Eligibility

You must provide accurate account information and keep it current. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us promptly of any unauthorized use. You are responsible for the acts and omissions of anyone you invite or permit to access the Service through your organization.

6. Acceptable Use

You agree not to misuse the Service. You will not use it for any unlawful purpose, attempt to gain unauthorized access to it, interfere with its operation or security, reverse engineer it except to the extent permitted by law, resell or provide it to third parties outside your organization without our consent, or upload content that is unlawful or that infringes the rights of others.

7. Your Content and Data

You retain ownership of the data and content you submit to the Service ("Customer Data"). You grant TruStar the rights necessary to host, process, and display Customer Data for the purpose of operating and improving the Service and providing it to you. You are responsible for the accuracy and legality of your Customer Data and for having the necessary rights and consents to provide it.

We handle personal information in accordance with applicable privacy law and our privacy practices. We do not sell your data.

8. Intellectual Property

The Service, including its software, design, and content provided by TruStar, is owned by TruStar or its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to access and use the Service during your subscription. We reserve all rights not expressly granted.

9. Subscriptions, Trials, and Payment

Access to the Service may be offered on a free trial or paid subscription basis. Fees, billing cycles, and plan limits are described at the time of purchase. Unless stated otherwise, fees are payable in advance and are non-refundable except where required by law. We may change pricing on renewal with reasonable notice. Failure to pay may result in suspension or downgrade of access.

10. Availability and Changes

We work to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. We may modify, add, or remove features, and we may perform maintenance that temporarily affects availability. We will use reasonable efforts to limit disruption.

11. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, TruStar disclaims all warranties, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service, or any output or content within it, will meet your requirements, achieve any particular safety or compliance result, or be accurate or complete.

12. Limitation of Liability

To the maximum extent permitted by law, TruStar and its directors, officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or for any personal injury, illness, death, property damage, or environmental harm, arising out of or relating to your use of, or inability to use, the Service, even if advised of the possibility of such damages.

To the maximum extent permitted by law, the total aggregate liability of TruStar arising out of or relating to these Terms or the Service will not exceed the amount you paid to TruStar for the Service in the twelve months immediately before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

13. Indemnification

You agree to indemnify and hold harmless TruStar from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your Customer Data, your safety program and operations, or your breach of these Terms.

14. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, fail to pay, or use the Service in a way that creates risk or liability. On termination, your right to use the Service ends. We will make Customer Data available for export for a reasonable period where practicable, after which it may be deleted in the ordinary course.

15. Governing Law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there, without regard to conflict of laws principles. The courts located in Alberta will have jurisdiction over any dispute, subject to any mandatory consumer protections that apply to you.

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will take reasonable steps to notify you, such as posting the updated Terms with a new effective date. Your continued use of the Service after the changes take effect means you accept the revised Terms.
